That fact that this dish is being served in a joint on Long Island? (you can't find palatable Chinese food east of Flushing in Queens)
Shark fin soup is served in every restaurant in Manhattan's Chinatown. It's pretty yummy too!
It's perfectly legal to serve and consume shark fin soup, on Long Island, or anywhere else in the United States for that matter.
Shark fisheries within the U.S. are highly regulated. Recent legislature will require all sharks landed within U.S. waters to be landed with their fins intact. The shark meat is consumed.
I'm not sure what your problem with this is. There is plenty of illegal shark finning taking place throughout the world. If you are so displeased with this, go and protest at the embassy or trade mission of virtually any nation that has access to an ocean. Or better yet, write a letter to Peter King and ask him to introduce a bill requiring shark fins imported into the U.S. to have a certificate of origin proving the fins were harvested lawfully...
