    legal issue's? off Miami or florida

    I'm currently writing a short story for school and I need to know if there are any legal issue with picking up illegal immigrates off shore and bring them to land.


    Scenario being a shark is eating people in the water and you see them, while you’re drifting for swords?


    I would not like to have opinions voiced on the immigrant subject, just the legality in this situation.

    Very Interesting subject man and I would be interested in reading your story when its done.

    My guess is if you came up on humans floating in the water the first thing you would do as a capt or operater of the boat is call the coast guard. So at that point you have already told them the situation.
    But knowing our laws I would love to know the real answers.

    well i believe if the CG came and picke dthem up, either out of the water or off your boat, that they would take them ti INS and they would be shipped back home. if you picked them up and brought them to land that would be a different story. of course if the CG found out you did that without notifying them then the legality issue might be brought upon yourself.

    Pull them out of the water then call the CG/Customs on the radio. There is never a problem rescuing a person from peril at sea, it's what you do after the rescue that can get you in trouble. Once they are onboard, call the CG and follow their instructions.

    As for your school project, you can call the CG district that serves your area and get plenty of good info that you can accurately quote. Search on the web then contact their public relations officer.

    Difficult situation, out the water a must, you will not live with yourself if you leave them. Next must be the coastie you have no Idea who you have on your boat friend or "foe" You put them on a beach and they drop a tower then how you feel?

    Not sure about Florida but here is one scenerio for you.

    My brother is a mate on the Charter Boat Lil' Angler out of Lewes, De. They had a charter and were bottom fishing the Delaware Bay. The weather was kind of nasty and the seas were pretty bad for the bay. While the captain was up on the bridge my brother was down on the deck helping the customers. He heard what sounded like someone calling for help. It was faint but he heard it. He started looking around and spotted something in the water about 200-300 yards off the stern. He went up to the captain and told him. The captain looked and didn't see anything. They searched for awhile and then saw it again. They went over in the boat and found a garbage bag floating in the water. The captain told my brother he was hearing things. They left the bag and went back and resumed fishing. My brother heard it again and this time he spotted a person about 100 yard from the bag they were just at. He got the captain's attention and they motored over and picked the guy out of the water. He told them he fell off a cargo ship entering the bay and that the bag they saw was his belongings... (HMMM... Fell off the ship and he had his belongings..HMMM) Well not wanting to cause any trouble they radioed the coast guard. The cost guard told them not to bring him ashore and DO NOT ACHOR. Apparently if they woud have anchored it would be the same as bringing this person ashore... The coasties met them out where they were and took the guy into custody. The captain nor my brother ever heard of what they did with the guy.

    Speaking of Cuban specifically:

    If they are picked up by the authorities in the water they go back(that's why you often see videos of the cops talking them in the water, If they make it to dry land they can apply for political asylum. There was a whole twenty twenty on it a couple of years ago.

    To answer your question: Inform Coast Gard Pick them up and wait it out at sea to turn them over to the CG. By not informing the coast guard I would think you could become an accessory.
