    It just seems to me, ...pause not to go off here.., that there are way more serious problems that our country is facing...than focusing on the liberals stance on overnight saving the fisheries...I mean come on..work on this when things are economically better..not when the real unemployment rate is about 16%...

    "marshall law" applies to all Americans..think about it..this is where this is headed with this guy.

    Martial law is the imposition of military rule by military authorities over designated region(s) on an emergency basis—and often, but not necessarily, only temporarily—when the civilian government or civilian authorities fail to function effectively (e.g., maintain order and security, and provide essential services), or when there are extensive riots or protests, or when the disobedience of the law becomes wide-spread. In most cases, Military forces are deployed to quiet down the crowds, secure government buildings and other key or sensitive locations, and maintain order. Generally, military personnel replace civil authorities and perform some or all of their functions. The constitution could be suspended, and in a full-scale martial law, a high-ranking military officer could take over, or be installed, as a military governor or as the head of the government.
    In addition, martial law can be used by governments to enforce their rule on the public. Examples: after a coup d'état (Thailand 2006); when threatened by popular protests (Tiananmen Square protests of 1989); or to suppress the opposition (Poland in 1981). Another example would be The October Crisis which took place in Canada in October 1970. Martial law can be declared in cases of major natural disasters also; however most countries use a different legal construct, such as a "state of emergency".
    Martial law has also been imposed during wars or in cases of occupations in the absence of any other civil government. Examples of this form of military rule include Germany and Japan after World War II or the American South during the early stages of Reconstruction.
    Generally, the imposition of martial law accompanies curfews, the suspension of Civil law (legal system), Civil rights, and habeas corpus, and the application or extension of military law or military justice to civilians. Civilians defying the martial law could be subject to military tribunal, called a court-martial.

    I sit here in a rare quiet mood... Really astounded by events of the last year or so. It's past what my worst fears might have dreamed. Yeah much of my contempt is based on the virtual rape of our rights as fishermen. The other part rests in the overall disregard for the American people and their will at every turn that bugs me most.
    Our senators are fuming over the deaf ear they're receiving when trying to hammer some sense into Lubchenco. She sits there like a bobble head nodding and appearing to understand then blatantly ignores them and continues on this mission.
    Could it be that we are at the edge of an honest to goodness civil war? I have never felt this way before. I bleed red white and blue and for a while I have said that being American has less and less redeeming values. Today it's embarrasing to a degree.

    Ill give you all time and staff and our money and our knowledge and our staff to be heard but you will need to make sure we get the content we need.

    ONTARIO - The first wave of hard evidence documenting the corruption and conflict of interest that's guided the implementation of the 1999 Marine Life Protection Act surfaced at the meeting of the California Fish and Game Commission at the DoubleTree Inn this past week.

    The commission accepted public testimony again on the so-called Blue Ribbon Task Force's recommended ocean fishing closures and protected areas along the Southern California coast before adopting a final plan. During Wednesday's testimony, documentation was provided that proved that two members of the Blue Ribbon Task Force, Bill Anderson and Greg Schem, lied to the commission at a recent meeting about having a business association.

    Bob Fletcher, former president of the Sportfishing Association of California who's been involved in the entire MLPA process, said there was evidence that both members agreed "to sign off on everything else" in return for not putting a reserve on the Rocky Point area between Redondo Beach and Long Beach where both had marinas and business interests.

    Fletcher and others at the meeting say this is just the tip of the iceberg. Sportfishing groups are gathering evidence on three other issues that have plagued the process.

    First, Michael Sutton, a member of the Fish and Game Commission and a key supporter of vast closures, has been charged with conflict of interest and repeatedly asked to recuse himself on all MLPA issues. Sutton works for the Monterey

    Bay Aquarium, which stands to benefit financially from Department of Fish and Game funding to help implement and monitor protected marine areas.

    When a complaint was filed with the state Fair Political Practices Commission last year, however, it wasn't investigated. Sportfishing groups are looking into whether anyone from the governor's office tampered with the issue.

    In an incredible case of irony, Sutton is also on the FGC's Marine Resources Subcommittee with commissioner Richard Rogers, and recused himself recently when the issue was collection permits because his employer, the Monterey Bay Aquarium, has a vested interest in the collection permits.

    Second, there's growing evidence that former Fish and Game commissioner Cindy Gustafson was asked to resign when she, along with two other commissioners, questioned the science involved in some of the proposed MLPA recommendations.

    She was replaced by Don Benninghoven solely because of Benninghoven's support of the most restrictive MLPA designations, giving the closure supporters a 3-2 majority on the commission.

    Benninghoven came to the commission after a two-year stint on the Blue Ribbon Task Force.

    Third, at least 12 of the members of the MLPA science advisory team are fully or partially financed by grants from the Packard Foundation and Ocean Protection Council, both of which have been outspoken proponents of the MLPA process' most restrictive protections, including vast areas closed to all fishing.

    The science advisory committee refused to consider catch-and- release sport angling and sport take restrictions as a management option that was less damaging to the marine environment than unrestricted commercial fishing. A catch-and-release angler fishing barbless jigs for calico bass was the same as a commercial gill net to the majority of the science advisory team.

    Sportfishing interests have said the whole public process was a sham after the Blue Ribbon Task Force essentially ignored the proposals from the three volunteer study groups that labored for 18 months before forwarding their own recommendation to the Fish and Game Commission, which was a breach of what the volunteers had been assured at the outset would happen.

    The Blue Ribbon Task Force has also refused to take into consideration the state's economy and budget, and how closures will affect business and recreation in the region.

    Fletcher said it was likely, with the state's budget crisis, there won't be funding to finance the MLPA. Last year, the legislative budget office stripped all funding of the MLPA implementation out of the Department of Fish and Game's budget, but its funding was continued by the governor's office by backfilling with Proposition 84 funding.

    This year, the budget office is again likely to recommend that funding be stopped - and that Proposition 84 funds aren't used again.

    "The whole process is rife with conflict of interest," said Fletcher. "It has been hijacked."

    maybe. Things are moving too fast on the Federal level right now.
    Also I don't hear denials from the administraion on these issues. Lubchenko and Schwab definitely feel they are on the right course.

    No one will want to hear this, and frankly it won't change things, but we're reaping what we've sewn.

    Somewhere along the way we forgot the first sentence of our founding document.

    "We the people of the United States, in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the United States of America."

    We are now dealing with yet another unintended consequence of legislation that was intended to help manage our fisheries. We're dealing with a complex web of government that has attempted to retain sustainable fisheries in this country, when the only thing they've consistantly sustained has been themselves.

    I commend John for giving us this amazing place to talk fishing and share what we know. I also commend him for what is to come. It's time we all get involved before it's too late. Without a seat at the table they will continue to do whatever they want, regardless of the administration. Stand up, get educated, and join the conversation. You can only blame yourself if you don't

    Do you all care?

    If you want help we can help. We all need a voice. Sadly as of now our voices are all over the place.
    I heard amazing stories about people loosing jobs and buisness getting shut down. But after I heard them that was it.

    Please take my advice and post it! The more people you can get into the forums above posting the better work we can do.

    Get family friends and put together good info on the effects of all of this.
    At the end of the day sportfishermen.com will go by the way side and ill run some other site. But my kids deserve to enjoy the sport of fishing.

    I will put alot of resource into getting your messages heard but you need to put effort into getting people to do it.

    Trust me numbers can put on pressure on those that need pressure.

    Give some time and ill give you everything I have.
