Set it on the bait(marks), floats and lead keep the net vertical in the water while it slowly sinks, boat keeps the net stretched out...bunker swim through mesh and get gilled.

yes in most areas if they are legal.

We used to use sink nets quite a bit off the OBX to catch big pogies for king mackerel fishing. While you might set 100 or 200 yards of gill net, letting it soak for a good while, with a sink net for bait you only set 30 yards or so right on a bait mark. You set it then go back and start picking it back up right away so the pogies don't die in the net. You might have to do this a couple times but it works great when the water's too deep for a cast net.

It's the same as a gill net, which is illegal in lots of places so check first regarding the licensing, legality, etc.
