    CLEARING UP SOME CONSORTIUM ISSUES

    LETS SAY A BOAT OWNER OR CAPTAIN NEEDS A FILL IN MATE AT THE LAST MOMENT

    THE LAW STATES THAT A FULL TIME MATE OR CAPT MUST BE REGISTERED UNDER THAT VESSELS DRUG CONSORTIUM...........TRUE


    OKAY......BUT..............IF A MATE OR CAPTAIN IS REGISTERED UNDER YET ANOTHER VESSEL OR PROGRAM AND SHOWS PROOF OF SUCH.....AND WISHES TO FREELANCE PART TIME TO DO FILL ION WORK.....ALL IS WELL

    § 16.210 Pre-employment testing requirements.

    (a) No marine employer shall engage
    or employ any individual to serve as a
    crewmember unless the individual
    passes a chemical test for dangerous
    drugs for that employer.
    (b) An employer may waive a pre-employment
    test required for a job applicant
    by paragraph (a) of this section if
    the individual provides satisfactory
    evidence that he or she has:
    (1) Passed a chemical test for dangerous
    drugs, required by this part,
    within the previous six months with no
    subsequent positive drug tests during
    the remainder of the six-month period;
    or
    (2) During the previous 185 days been
    subject to a random testing program
    required by § 16.230 for at least 60 days
    and did not fail or refuse to participate
    in a chemical test for dangerous drugs
    required by this part.

    As I understand it, you may show proof that you are enrolled in a random testing program.
    With that being said, for those that do not fall under where you qualify under another persons "random testing program" you can or may form your own company and require that said employees of your company be subject to " random testing". Therefore you will meet the requirements needed. A lot more work, yep but it gets you covered and if you do it as a Corp. or LLC it gives you some sort of protection from liability. Don't take what I said to the bank, but this is how I understand it and I could be wrong...sounds like a lawyer talking, doesn't it...

    Box, If I read your post right, since my employer already has me on a random testing program, I am OK to fill in as a Capt. or mate if I have the opportunity.

    Don't you still have to be up to date on CPR?

    To Consortium or Not To Consortium......that is the question.

    As it stands right now, I will be able to qualify as an Angler in the Pirates Cove tournament, because my last pay gig was in June '07. So by the time it gets here, I will not have done any pay work for a year and be eligible.

    That being said, I will have to make a choice. Get my card in preparation to Freelance the NC tourney circuit or only Fish the Pirates Cove.

    If I got on for the PC, then I wouldn't need to spend the money to re-up. But if I don't reup, then techincally I wouldn't qualify to Freelance.

    Yes you still have to keep your CPR and First aid up to date, but that is another story...

    Sea Draggin, here is something else for you to ponder...
    Being on a random drug testing is a requirement with the USCG and must be reported each year to them to stay in compliance with holding you Capts. license. I am a member of "The Maritime Consortium, Inc" and they do this for us. Worth the $70.00 I pay each year, not to have to file this paperwork...
    It has always amazes me how hard to stay in compliance with every thing, it is, almost imposable to do and sooner or later it going to catch some of us off guard, epically the part timers...

    I have never had any trouble keeping up the licenses, permits etc. Honestly, I just don't see any future in part time operations. There is not an overflow of business to really do it successfully. And by the time you spend all the profits on permits and overhead, you might as well do something else part time, then use that money to go fish.
