Cummins lawsuit?

Any piece of equipment (engine or other wise)you buy is only as good as the DEALER you have in your area. I know this from experience and practice. As many know I am a Cummin's dealer and Cummin's know's for "dead sure" that I stand behind my customer's. I have had warrantee and "policy" repair's (repair's done when the engine is out of warrantee) for my customer's when alot of other dealer's can't or haven't. How??? Because I hold a company's feet to the fire! When there is an obvious problem I go to the source to get it rectified. The trouble I see is that alot of dealer's (regardless of brand) won't go to bat for the customer's they service. Some are afraid to make waves and get some corporate honcho mad with them. Myself I really could care less. Right is right and service sell's, period. I have had many occasion's when I wasn't on the Cummin's Christmas Card list because I ruffled some feather's, but MY customer got taken care of. My experience has shown me that customer's remember you going the extra mile.
I personaly have never hired a lawyer to do my bidding and I hope that never changes. I guess there are times when it has to come to that. So far I'm satisfied that a man's word should mean something. Frank

seapower, have you had to deal with any aftercooler problems like the ones in the lawsuit? if so, any suggestions on how to handle it? i dont see any reason not to make the claim at the moment - a little down time now could be well worth avoiding a failure later on. but let me know what you think

fortunate one, it appears the case is already over and the settlement entails a free retrofit, a full repair, for anyone with a 6B, 6C, or QSM-11. the warranty stays in place, i think...so i don't think the complications you're bringing up apply here. i think Cummins' liability is pretty much set in stone since the case is done and they have to make the repairs for free. im no lawyer, but that's what it seems like to me.

I haven't had the first claim on this. I learned about this "problem" here on SFC. I called Cummin's to see if there was something really going on, they made note of this case. I have quite a few of these engines around, owned a few myself on my work boats (back when I Comm fished), hasn't been an issue. Not saying that the sky couldn't fall in tommorrow. But so far just many several thousand hour's out of these engine's without a problem coming from the aftercooler's. Just lucky I guess.
You can alway's get your "Dealer" to run your serial number and see if there is a "campaign" out on your engine for this re-fit. Frank
