Contract for Captain

Greetings -

I am hiring a captain for this year and would like to have a contract that spells out duties as well as matters such as tournament splits. Also need to cover insurance matters and all the other legal stuff I don't know about.

Does anyone have a sample contract they could share?

Hey George,

I did not want to let this go with no response. I do not think there is a "standard" contract for a Captain job. In My opinion, it would better serve both Parties to draft a mutually agreeable contract based on specfics. By specifics I mean, size and age of Boat, how much fishing vs. cruising, maintenance of Boat and tackle and so on and on. Of course there is alot more to consider but I hope this helps. Good Luck.

You may want to speak with an employment attorney, or at least a local attorney about a standard employment contract, epecially one involving insurance.

I think a list of norms would be nice to see. What does a boat owner get for the money he pays a captain, other then the safety reliability and experience of the captain.

A great deal depends on if you are paying a salary or if the captain is going to be a contractor. I would suggest that if your captain an independent contractor that he takes a blanket liability policy out for his own pretection.
Most contracts are common sense such as duties to perform, salary, benefits, and also reasons for dismissal/termination. Also it should include what the captain should expect as far as notice of termination, tournament percentage, paid expenses when at tournaments and away from home port such as transportation, food, lodging, personal expenses,etc.
