Was thinking, there are guys out there who depend on the BFT fishery for there livlyhood and may get screwed with an ESA listing. Since the buzz is that an ESA listing is being justified by the likelyhood that the BP spill damaged the spawning grounds this would mean your business could be effected by the spill. Simple.

What is not simple is if and or how long such a listing might take. If you fall in that catigory you may want to assert your rights by sending a certified letter to BP that you reserve the right to to seek damages from them in the event such a listing happens or if the spill actualy does effect the fishery. This may prove very helpful 2,3 or ten years from now by having a time stamped document for the cost of a $3 letter.

At least talk to your lawer about it.
