The most fundamental change in history in the relationship between the "people" (serfs, minions, slaves, citizens, you name it) and governments of all types was the...

...wait for it...

...subordination of government to the rule of law.

This subordination started in earnest in England with the Magna Carta and the result was that throughout the centuries that followed up an until now English speaking people's of the world have enjoyed the greatest freedom of all peoples. You see, there's a direct relationship between individual freedoms and the constraint of government by the rule of law. Makes sense, right?

Althought he was not the first American president to test the envelope of the rule of law, George W. Bush has wholly reversed this subordination of government to the rule of law in America, particularly executive branch government.

His administration flouted the rule of law like none before it by invoking the Unitary Executive theory of Executive Branch freedom of action during wartime. This, in all its manifestations during the Bush years, is easily the most serious breach of the dominance of the rule of law and easily the most serious abrogation of the Constitution in the history of the country.

Regrettably, what many of us thought was going to be the anti-Bush, Obama, has turned out to be a dud of the greatest mangnitude. The power grabs of the Bush Administration remain wholly unchanged in the Obama Administration. A fundamental breach in the compact between the citizens and their government has been secured for what seems now like eternity.

It seems presidents, no matter the party, mail rail against executive excesses on the campaign trail but do little to nothing about reversing those same excesses once in office.

The loss of constraints on government by the rule of law just gets worse and worese with each passing administration. But it was grossly accelerated by Bush II. Ominous, indeed.
