You are an attorney; when did it become OK for a federal investigation into something and or someone who may or may not have done/participated in an activity which was LEGAL and not against the law or any "rules of the game" during the time period parameters?

Saying "We would like to know the extent of PED's in baseball" is one thing. Saying that YOU (an individual) MUST answer our questions regarding a non-illegal (ie:legal) activity that we think or that someone said you did in the privacy of your own home, is bullshit.
Nobody asked any athlete to be the second coming of Christ, or swear on the bible during the time they are sworn into office. To destroy a man's career and public persona over this is horrible. THE GOVERNING BODY turned a blind-eye towards this activity. If anyone needs to be grilled, it is MLB, not Roger, or any other player.
But Federal Charges against someone regarding a private activity which was not illegal at the time because they don't want to discuss it? Is this right?
