    Quick boat buying question

    Hey guys, I ordered a boat at the AC boat show and it was supposed to be in mid April. However, its not due in until mid June. I recently decided to take some summer classes this summer. So I decided to cancel the boat. I was hoping to reorder at the fall in the water boat show. Also hoping to upgrade the size after I start new job. That way I would have it for the full season next year. My question is, the marina says I lose my $1000 deposit. Is there anyway I can get it back? Am I wrong for feeling a little burnt. I know its not alot of money, but its a 1000 towards the next down payment. If the boat was on time I would be out fishing this weekend instead of sobbing. Anybody else have any experience in dealing with new boat transactions? Sorry for the long rant, thanks for any advice.

    If you have a delivery date in writing then they defaulted and you are entitled to a refund, if not then it's going to be a long hard fight, that you may or may not win.

    Rookie, good luck. As Graceland said if you had a delivery date then you might win but like Frank said it all depends on your contract. Keep us informed on how you make out. It is ashame that they couldn't deliver for you. when I bought my first new boat it came in a month and a half late. That drove me nuts. I can relate to how you feel.

    Yea I have a contracted but they conviently left the delivery date blank. The Angler rep said it would be 6-8 weeks, but the dealer said 10 weeks to be safe. I would have been happy if it was gonna be in by memorial day weekend. Which would have been like 15 weeks. We have a family friend who is a business attorney, so we'll see what he can do. It sucks, because now I have to find another reasonable priced boat I like and a new marina. Oh well, theres plenty of marinas out there.

    man those contracts are a bi$%h. I got it like that on a real estate deal. Sold our house and signed a contract to buy another. The house we were going to move into they couldnt get a clear title to the house because many years ago they built the house on the sewage reserve area!
    we went to settlement and sold our house waiting for the PW to get cleared up. Meanwhile we had no house to move into. well turns out they couldnt get it cleared!! we spent the next 30 days in a hotel with our furniture in storage. then the realtor had the do dads to sue us for her 3% commision for a house we could not move into. Around 14,000 was her comission. A I thought she was out of her mind!!

    She said....read your contract it clearly states....if buyer enters into contract "TO" aquire property a comission of 3% will be paid to the realtor.

    If it would have read....Buyer enters into contract "AND" aquires property......etc....it would never have been an issue. she said she did her job to find the house and we entered into a contract to aquire a property. I was Pissed! Dumb me I signed a 6 months buyers agreement with her. There was no way I was going to pay her a cent so we rented for 6 months just so my contract with her would expire. I fought it and won but it was a lesson. Not to mention 3,000 for the attorney. Now I NEVER sign a buyers agreement with a realtor. Most cases you have to when purchasing a home but I will sign the buyers agreement for THAT house only. If it falls through we start from scratch. Never sign a buyers agreement for ANY length of time!! Those buyers agreements suck

    READ THE CONTRACT!!

    That sucks, im only out a grand so I guess its not that bad, but when your 22 a grand goes far. Im a realtor here in NJ so I should have known better. Many hours spent going over contract crap. Guess you just get caught up in it all. I didnt think it would be a big deal cause I was told I would also get a test ride and cancel then if I didnt like the ride. Lesson learned, back to looking at boats for me. Im kinda like the sea hunts better then the angler boats anyway. Thinking maybe an 18' center console to get me started.

    Maybe wait for the boat to deliver and then sea trial it and turn the boat down based on the sea trial...don't like the ride, too wet, too harsh, etc. Don't know if it would work but it can't hurt to give it a try, might get your grand back.
