    Angry Kick in the Scuppers!

    Well the day was going along swimmingly til a knock came at the door. Post lady with a signature required letter... Never a good thing so I opened it right up.
    It seems that the marina where I keep my skiff has taken posession of it with plans to sell...
    They state for non payment. I am on automatic payment there and I have the proof in hand that payments have been made. This is their error plain and simple... Here is where it gets good. There is a lien company involved that has about $900 worth of fees that I am supposed to pay before they release the boat back to me???? I think I need an attorney... Anybody familiar with one who would have info in this area?

    If you have all receipts and/or canceled checks/bank drafts you don't need an attorney. Simply go down to the Courthouse and file a motion to remove the mechanics lein.--- real simple with a hearing.

    what glenn said...collection agency threatened me for two years in two states. i had the cancelled check. over and over they tried to tell me it would be cheaper to "settle" than hire a lawyer and fight. over and over i told them i would never hire a lawyer, i would just bring the cancelled check to court. eventually they gave up........but i always wondered how many cave.

    Deep- I would think that the Marina would have sent you numerous statements saying that there was money owed and then serve you with a certified letter threatening to sell it before turning it over to a collection agency. Did you confront them about this? Also, if they turned it over to a collection agency and even though you have the proof that it was paid, keep an eye on your credit report- they might even try to add it to your report.
    I have been fighting to have something removed from my credit report that is not and never was true. It was supposeedly removed, but everytime I run a check, it is still there. What I'm trying to say here is, keep on top of it, cause people are too lazy to fix it and just BS you!!

    Ditto what Glenn said. How long do they claim you have not paid? Im not sure what the process is in Florida for a mechanics lein but here in PA it takes us months to get it done.

    Not word one. This was out of the blue... Their error but they don't want to pay the lien company who is preparing to auction the girl. Need court injunctions quick... Hard receipts are in hand. Debit co shows never a rejection or anything... They claimed six months but with proof in hand that it was paid they switched gears.
    Went to their city hall (city owned) (Riviera Beach ). City manager not avaliable. Marina manager not in town. Mayor not in. City attorney says she has no power to correct... Assistant manager won't drop lien even with hard copy in his face. Cash only for lien release. Something stinks at the dump.
    I have been there at the dump for fifteen years without issue. New hands there. Last September they threatened every slip holder with confiscation unless they provided insurance doccumentation. I had to drive back a few days early from Jersey to hand them the doccumentation that they said they didn't have. There it was in my file when I went to drop it off...

    They went through last year on a sweep to lose the non payers and abandoned ones... Flushed a couple hundred. Upped the ante wanting proof of ins, reg, cg compliance, etc... Witch hunting inorder to clean the place up... Loads of errors along the way make the place almost a daily fixture in the papers or TV... The whole town is a mess. The good marina where I keep Deep is about twice the price.
    Same problem with this boat as the Deep. Really don't use enough to justify keeping but if I did sell it could never be replaced for what the market would bring right now...

    We used a do-it yourself yard once down here and while re-building our 42' hatteras we had stuff go missing at night while it was in our dock boxes.. next we had a guy say that he did 6 hours one day on our boat..and 3 hours for two days later that week... we rented the forklift to pull old motors I had everything ready- it went 1.42 hours ...they charged for 3.5... they said we owed them $1100.00 ... I was so pissed we just paid it. we also had cape ann come and tow us to cable marine that afternoon. get things in writing and keep reciepts it's the only way to defend yourself. when I give a man a price for rebuilding his boat I give it in writing where we both have a list copy and the final price. but then again I do good work
