    we have the same problem in my neighborhood. we are trying to find some way to make it mandatory for new home owners to join the hoa.

    you are right hubris 1. .......The CA that can not come to a civil agreement in this are appointed a county liaison. This brings in code enforcement and a snoop doggie dog walking self appointed governor into the neighborhood. Life soon becomes a bit@@ for the homeowners. All homeowners.....As I see this......a fourwheel drive pick-up is a viable answer to the road improvements in the long haul The state will give a guaranteed note for road improvements with a low interest rate in some cases. I say apply the note...get the roads...then sell sell sell and move to gilbertsville, pa

    This probably won't go over real well but we had a simular problem where I used to live. The HOA fees were voluntary and were only about $50/year. We had a waterfront playground and a recreation building that were supported with the money collected. We also had free events for the children (Easter/Christmas/Holloween) and others. About 50% of the 140 homes in the community paid their dues. EVERYBODY benefited from the improvements. They either used the amenities or benifited by having more valuable property.

    Eventualy the folks paying the bills got tired of the freeloaders. We had the county set up a special tax district. The HOA dues got paid along with the property taxes. The community still got to use the money any way they wanted. The HOA fees actualy went down because EVERYBODY paid.

    I'll preface my advice with a little background info. I'm an engineer, land surveyor, & real estate agent in the state of MD. My advice is to look at the plat that created your subdivision. When property is subdivided a plat (or map) is created which shows all lots, roads, property markers set, etc... There should be a note on the plat referencing the private road servicing your subdivision. There may be some verbiage in that note referencing the individual homeowners as responsible for the maintenence & upkeep of the road. In a legal scuffle between the HOA by-laws & a RECORDED plat, the plat will win, ALWAYS. That's in MD, mind you. I'm not familiar with the laws in NC. You can find the plat reference number in your Deed, which you should've received when you bought your house.

    For the record, in the state of MD, a private R-O-W is technically a use-in-common access easement, NOT a R-O-W. Big difference.

    I looked at the last private road I recorded. In MD, Anne Arundel County to be specific, with a private road there needs to be a Private Right of Way Maintenence Agreement recorded prior to plat approval. The recording numbers (Liber/Folio) will be noted on the plat. The agreement sets the legal precedent to place a lein on your neighbor's property for the roadwork.
