I had my day in Accomack County, VA court for hunting over bait........................NOT GUILTY!!No surprise to me...getting the state to see it my way was the tough part.
I had a damn fine attorney and learned quite a bit about the VA statute regarding hunting over bait. Basically, you must know (i.e. put it there yourself) or should have known (i.e. evidence of bait on the bank, in the blind, etc or a load of ducks using and wanting to keep getting back into the same spot) the bait was there. Based on the statute, there is a great burden of proof on the state to prove their case. I only tell yall this in case some other poor soul unknowingly hunts over a baited area and gets cited....and that's all I'm going to say about that.
