TRENTON — New Jersey's black bear hunt will go forward after a three-judge appellate panel ruled that the state Department of Environmental Protection met its burdens in preparing the 2010 bear management policy.
In a 37-page decision, released late Thursday morning, the panel ruled that there were no procedural problems with how the DEP drafted the policy.
The appellants, the Animal Protection League of New Jersey and the Bear Education Resource Group, had filed suit in an attempt to have the hunt canceled and the DEP's policy declared invalid.
"Most important, we conclude that appellants have failed to demonstrate that respondents acted arbitrarily or capriciously or in bad faith," the decision reads.
Doris Lin, attorney for the animal protection groups, said her clients were disappointed with the decision and that she plans to appeal to the state Supreme Court.
